O-1, EB-1A and EB-2 NIW in 2026: US Visas and Green Cards for Talent Without an Investment

Talent routes are my favourite part of US immigration because they reward a career, not a bank balance. They suit researchers, founders, engineers, artists, athletes and senior managers. Below are the rules from USCIS, the Visa Bulletin and the BRIDGES O-1 page, checked on 4 November 2026.
O-1A and O-1B: the temporary visa
The O-1 visa is for people with extraordinary ability in science, education, business or athletics (O-1A) or in the arts and film (O-1B). For O-1A you need a major internationally recognised award or at least 3 of 8 criteria, such as:
- nationally or internationally recognised prizes;
- membership in associations that require outstanding achievements;
- published material about you in major media;
- judging the work of others;
- original contributions of major significance;
- scholarly articles;
- a critical role in distinguished organisations;
- a high salary compared with others in the field.
A US employer or agent files the petition. The first period is up to 3 years, then extensions of 1 year at a time without limit. With premium processing USCIS answers within 15 business days.
EB-1A: the green card for extraordinary ability
The bar is higher than for O-1: a major award or 3 of 10 criteria, plus a final merits review of sustained acclaim. The big advantage is that you file Form I-140 yourself, without an employer and without labour certification. EB-1 is current for most countries in November 2026. China has a final action date of 1 August 2023. EB-1C, for multinational managers, uses the same queue.
EB-2 NIW: the national interest waiver
EB-2 is for professionals with an advanced degree or exceptional ability. The national interest waiver removes the need for a job offer and labour certification if you meet the three Dhanasar prongs:
- the proposed work has substantial merit and national importance;
- you are well positioned to advance it;
- on balance, waiving the job offer benefits the United States.
Approval rates have swung. According to USCIS data reported by immigration firms, they fell to about 36% at the end of fiscal year 2025 and recovered to about 55% by mid 2026. USCIS can also deny without a request for evidence if the initial evidence is missing, so the first filing must be complete. For most countries EB-2 has a final action date of 1 April 2025 in the November 2026 bulletin.

Fees
Form I-140 costs $715 on paper or $665 online, plus an asylum program fee of $600, reduced to $300 for self-petitioners and small employers, according to the USCIS fee schedule. Premium processing is extra.
My honest view
If your record is genuinely strong, I usually suggest O-1 to move now and EB-1A in parallel on the same evidence. EB-2 NIW suits people with a clear project of national importance but a thinner record of fame. Both require months of preparation. Weak files get denied, and a denial stays in your history. Compare with the work routes and the complete guide.
Questions and answers
Do I need a job offer for EB-1A?
No. EB-1A for extraordinary ability is a self-petition. You must show sustained national or international acclaim and that you will continue to work in your field in the US.
What is the difference between O-1 and EB-1A?
O-1 is a temporary visa for up to 3 years, filed by a US employer or agent. EB-1A is a green card with a higher bar. Many people start with O-1 and file EB-1A on the same record later.
Who can apply for EB-2 NIW?
People with an advanced degree, or a bachelor's degree plus 5 years of progressive experience, or exceptional ability, whose work has substantial merit and national importance. No employer or labour certification is needed.
How long is the queue?
In the November 2026 Visa Bulletin EB-1 is current for most countries, with China at 1 August 2023. EB-2 for most countries has a final action date of 1 April 2025, so there is a wait of over a year.
